Terms and Conditions

These Terms and Conditions ("Terms") apply when you access or use www.olathelabel.com.au (the "Website") or purchase products from Ola The Label, ABN 48 729 096 387 ("Ola", "we", "us" or "our").
By using the Website or placing an order, you agree to these Terms. Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

2. Using the Website
You must use the Website lawfully and must not:

interfere with the Website's operation or security;

introduce malicious code;

attempt to gain unauthorised access to the Website, accounts or data;

scrape, copy or use Website content for a commercial purpose without our permission;

use the Website to commit fraud or infringe another person's rights; or
-
submit false, misleading, unlawful, abusive or harmful content.
We may restrict access to the Website where reasonably necessary to protect customers, Ola, our systems or other people, or where we reasonably believe these Terms or the law have been breached.
3. Product information
We take reasonable care to ensure product descriptions, images, sizing, colours, prices and availability are accurate. Colours and appearance may vary slightly because of lighting, photography and device-screen settings. Sizing and fit can also vary between styles and fabrics, so please review the size guide and product information before ordering.
Minor variations that do not affect a product's quality, description or intended use will not necessarily make the product faulty. This does not limit your rights where a product does not match its description, sample or other representations we have made.
Product availability may change without notice before we accept an order.
4. Orders and contract formation
When you submit an order, you are offering to purchase the products in your order under these Terms. An automated order acknowledgement confirms that we received your order but does not necessarily mean we have accepted it.
We accept an order when we send confirmation that it has been dispatched. For a digital gift card, we accept the order when the gift card is issued. For a pre-order or back-order, we accept the order when we send confirmation that the order has been accepted.
Before accepting an order, we may decline or cancel it for a reasonable reason, including:

a product being unavailable;

an obvious pricing or product-information error;
-
payment not being authorised;
-
an order being identified as potentially fraudulent or unauthorised;
-
purchase limits applying to a product or promotion;
-
an order appearing to be for unauthorised resale; or
-
us being unable to deliver to the supplied address.
If we cancel an order after payment has been taken, we will notify you and refund the amount paid for the cancelled product and any applicable shipping charge to the original payment method. We will not cancel an accepted order merely because we later decide to change a price.
5. Fraud and order verification
Shopify, payment providers and other service providers may automatically screen orders for fraud and security risks using information associated with the order, payment, device and transaction history.
An order may be held, declined, cancelled or referred for additional verification where a material risk is identified. We may contact you and reasonably request information needed to confirm that an order is authorised. You can contact us at hello@olathelabel.com.au if you believe an order has been incorrectly affected and would like us to review it.
6. Prices, GST and payment
Prices are displayed in Australian dollars unless another currency is clearly displayed for your selected country or region. Australian prices include GST where applicable. Shipping charges and any other applicable costs are shown before you complete checkout.
The final amount and currency payable are displayed at checkout. Your card issuer, bank or payment provider may charge currency-conversion or international transaction fees that are outside our control.
We accept the payment methods displayed at checkout, which may include card payments, PayPal, Shop Pay, Apple Pay, Google Pay, Afterpay and Zip. Buy-now-pay-later and third-party payment services are also subject to the provider's terms and eligibility requirements.
Payment must be authorised before we process an order. You confirm that you are authorised to use the selected payment method and that the billing information supplied is accurate.
If two different prices are displayed for the same product, we will comply with applicable pricing laws. An obviously incorrect price caused by a genuine error may result in the product being withdrawn from sale or the order being declined before acceptance, with any payment refunded.
7. Shipping and delivery
We normally dispatch in-stock orders within two business days. Dispatch may take longer during major promotions, peak periods, public holidays or events outside our reasonable control. Express shipping relates to the carrier's delivery service after dispatch and does not guarantee same-day dispatch.
For Australian orders:
-
standard shipping is $10;
-
express shipping is $15; and
-
standard shipping is free for orders over $120 after discounts and before shipping, unless a promotion states otherwise.
International shipping charges are calculated and displayed at checkout.
Delivery dates and timeframes are estimates rather than guarantees unless we expressly agree otherwise. We will take reasonable steps to dispatch and deliver orders within the stated timeframe and will contact you where we become aware of a material delay.
You are responsible for checking that the delivery name and address are correct before submitting an order. If you contact us before dispatch, we will do our best to correct an address, but we cannot guarantee changes. If an order has already been dispatched to the address supplied, additional redelivery or recovery costs may apply where permitted by law.
Risk in a product passes to you when it is delivered to the nominated address or collected by you or your authorised recipient. If tracking shows an order as delivered but you cannot locate it, contact us promptly so we can investigate with the delivery provider.
8. International orders
International customers are responsible for checking local import restrictions. Customs duties, import taxes and government charges may apply unless they are expressly included at checkout. Where they are not collected by us, they are the customer's responsibility. Customs processing may delay delivery and is outside our direct control.
Nothing in this section excludes rights you may have under mandatory consumer laws that apply in your country.
9. Pre-orders and back-orders
From time to time, we may offer products for pre-order or back-order. The product page will state the expected dispatch period and any specific conditions that apply. Dates are estimates and may change because of production, freight or circumstances outside our reasonable control.
Unless we state otherwise, an order containing in-stock and pre-order products may be held until all products are available. If a pre-order is materially delayed, we will provide an updated estimate and allow you to cancel the affected product for a refund if you do not wish to wait.
10. Changing or cancelling an order
If you need to change or cancel an order, contact us as soon as possible. We will do our best to assist before dispatch, but changes and cancellations are not guaranteed because orders may enter processing quickly.
Once an order has been dispatched, it cannot be cancelled as an order cancellation. You may still be able to return an eligible product under our change-of-mind policy or exercise rights available under Australian Consumer Law.
11. Change-of-mind returns
In addition to your rights under Australian Consumer Law, we offer change-of-mind returns on eligible products where:

the return is lodged within 30 days after delivery;
-
the product is unworn, unwashed, unused and in its original condition;
-
the product is free from makeup, tan, perfume, pet hair and signs of wear;
-
original packaging and swing tags are included where supplied; and
-
the product meets the hygiene and sale-item conditions below.
Approved change-of-mind returns receive store credit. We do not provide cash refunds for fit, sizing, colour, style or personal preference. Store credit does not expire.
The customer is responsible for change-of-mind return postage. Original shipping charges are not credited unless required by law. We do not offer direct exchanges; you can use your store credit to place a new order.
All returns are inspected before approval. Please follow the instructions in our Returns Portal and Returns Policy.
Underwear and hygiene-sensitive products
For hygiene reasons, underwear must remain unworn and unopened to qualify for a change-of-mind return. If you order multiple pairs, open and try only one pair over your own underwear before opening the remaining pairs. The opened pair cannot be returned for change of mind, but the remaining unopened pairs may be eligible.
Nipple covers and other sealed hygiene-sensitive accessories cannot be returned for change of mind once opened. These restrictions do not apply to rights relating to faulty, damaged, unsafe or incorrectly supplied products.
Sale and promotional products
Products discounted by 40% or more, products marked Final Sale, free gifts and promotional products cannot be returned for change of mind. This does not limit rights available under Australian Consumer Law.
12. Faulty, damaged or incorrect products
Our products come with consumer guarantees that cannot be excluded under Australian Consumer Law. Products must, among other things, be of acceptable quality, be fit for any disclosed purpose, match their description and match any sample or demonstration model.
If a product has a major failure, you are entitled to reject it and choose a refund or replacement, or keep it and seek compensation for the reduction in value. If a product has a minor failure, we may choose to repair, replace or refund it within a reasonable time. If we do not remedy a minor failure within a reasonable time, you may have further rights under Australian Consumer Law.
Contact hello@olathelabel.com.au with your order number, a description of the issue and photographs where reasonably available. We may need to inspect the product or request further information to assess the issue, but this does not remove your legal rights.
Where a product is confirmed to be faulty, damaged or incorrectly supplied, we will cover reasonable return-postage costs and provide the remedy required by law.
Change-of-mind time limits, hygiene exclusions and Final Sale conditions do not restrict remedies for products that fail a consumer guarantee.
13. Promotions, bundles and discount codes
Promotions, bundles, free gifts and discount codes may have additional terms displayed with the offer. Unless an offer expressly states otherwise:

offers are available while stocks last and during the advertised period;
-
eligibility requirements and purchase thresholds must be met after other discounts and before shipping;
-
one discount code may be used per order;
-
discount codes cannot be combined with sitewide sales, bundles or already discounted products;
-
free gifts have no cash or store-credit value and cannot be exchanged for another product; and
-
returns that cause an order to fall below an offer threshold may result in the value of the retained benefit being deducted from store credit, where this was clearly disclosed with the offer.
We may correct or withdraw a promotion affected by a genuine error before accepting an order. We will not retrospectively alter an accepted order except with your agreement or as permitted by law.
14. Gift cards and store credit
Purchased Ola gift cards and issued store credit do not expire. Gift cards and store credit:
-
can be used on eligible products through the Website;
-
are not redeemable for cash except where required by law;
-
cannot be used to purchase another gift card unless we expressly permit it;
-
must not be obtained or used fraudulently; and
-
should be treated like cash because anyone with the code may be able to use it.
Contact us promptly if you believe a code has been lost, stolen or used without permission. We may replace a remaining balance where we can reasonably verify ownership, but replacement is not guaranteed where the value has already been redeemed by someone using the valid code.
15. The Circle rewards program
Participation in The Circle may be subject to additional program terms displayed on the rewards page. Points and rewards are promotional benefits, are not legal tender and cannot be exchanged for cash. Earning and redemption rules, tier criteria and exclusions will be displayed on the Website.
We may make reasonable changes to The Circle to address fraud, technical issues, legal requirements or genuine changes to the program. Where a change materially disadvantages members, we will provide reasonable notice and will not remove an already issued store credit contrary to its stated terms.
16. Reviews, photographs and other customer content
You retain ownership of content you create. If you submit a review, photograph, video or other content directly to Ola or through a feature provided on our behalf, you grant Ola a non-exclusive, worldwide, royalty-free licence to store, reproduce, edit for formatting, publish and repost that content for Ola's website, emails, organic social-media channels and other brand communications.
This licence allows us to resize, crop or make minor formatting edits, but not to materially misrepresent you or the content. We will seek additional permission before using identifiable customer content in paid advertising unless the submission form, competition rules, creator agreement or other clear notice expressly included that use when you submitted the content.
Tagging Ola in a public social-media post may indicate that you are happy for us to view and share the post through the platform's native sharing features. It does not automatically grant us unlimited advertising rights. We may contact you to request permission for broader reuse.
You confirm that content you submit is accurate, lawful, based on your genuine experience where relevant, and does not infringe another person's intellectual property, privacy or other rights. We may moderate or remove content for a reasonable purpose, including where it is unlawful, misleading, offensive, irrelevant or breaches these Terms.
You may withdraw permission for future use of directly submitted customer content by contacting hello@olathelabel.com.au. Withdrawal will not affect uses already lawfully made, printed material already produced or content we must retain for legal or record-keeping purposes.
17. Intellectual property
The Website and its content, including Ola's branding, trade marks, product names, text, graphics, photographs, videos, designs, layout and software, are owned by or licensed to Ola and are protected by intellectual-property laws.
You may access and use the Website for personal, non-commercial shopping purposes. You must not reproduce, distribute, modify, publish, sell or commercially exploit our content without prior written permission, except where permitted by law.
18. Third-party services and links
The Website may contain links to or integrations with third-party services. Those services may have their own terms and privacy policies. We are not responsible for an independent third party's website, content or acts, but nothing in this section limits any responsibility Ola has under applicable law for services we use to fulfil your order or provide our services.
19. Website availability
We aim to keep the Website accurate, secure and available, but temporary interruptions may occur for maintenance, technical issues or circumstances outside our reasonable control. We may change or discontinue Website features where reasonably necessary.
To the extent permitted by law, we are not liable merely because the Website is temporarily unavailable. This does not affect an accepted order or any non-excludable consumer right.
20. Liability
Nothing in these Terms excludes, restricts or modifies:

consumer guarantees, rights or remedies under Australian Consumer Law;
-
liability that cannot lawfully be excluded or limited; or
-
liability caused by our fraud, wilful misconduct or negligence where it would be unlawful to exclude that liability.
Subject to those protections and to the maximum extent permitted by law, Ola is not liable for indirect or consequential loss that was not reasonably foreseeable when the relevant contract was formed, or for loss caused by your unlawful conduct, misuse of a product, failure to follow care instructions or provision of incorrect information.
21. Privacy
We handle personal information in accordance with our Privacy Policy. By using the Website, you acknowledge that you have had an opportunity to read that policy. The Privacy Policy is a notice explaining our information-handling practices and is not treated as consent where the law requires separate, informed consent.
22. Changes to these Terms
We may update these Terms to reflect changes to our business, Website, services or legal obligations. Updated Terms apply from the date they are published and do not retrospectively change the terms governing an order we have already accepted, unless required by law or agreed with you.
If a change materially affects an ongoing service or program, we will take reasonable steps to provide notice where appropriate.
23. General
If part of these Terms is found to be invalid or unenforceable, the remaining parts continue to apply.
Our failure to enforce a provision on one occasion is not a waiver of our right to enforce it later.
These Terms, together with the policies and offer-specific terms expressly incorporated into them, form the agreement between you and Ola concerning your use of the Website and purchases from us.
24. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and Ola submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
Nothing in this section prevents you from relying on mandatory rights or bringing a claim in another jurisdiction where applicable law allows it.
